1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Java Books, LLC ("Company," "we," "us"), the owner and operator of Know Thy Self for Business (the "App"). By checking the acceptance box presented when you first open the App, by continuing to use the App after a change to these Terms, or by otherwise accessing any part of the App, you confirm that you have read, understood, and agree to be bound by these Terms and by the Privacy Policy, which is incorporated here by reference.
If you do not agree to these Terms, you must not use the App. If you are accepting these Terms on behalf of a company, partnership, or other organization, you represent that you have authority to bind that entity, and "you" refers to both you and that entity. You must be at least 18 years old to use the App.
2. Description of Service
Know Thy Self for Business is a self-report questionnaire based on the Enneagram, a nine-point personality framework of unverified scientific validity. You answer a series of statements on an agreement scale. The App scores your answers entirely inside your web browser and produces a written reading describing a probable Enneagram type, a wing, and general tendencies interpreted for one of four business contexts: entrepreneurs, business owners, sales professionals, and business advisors. You may download that reading as a PDF or Word document or share it through a link that encodes your scores.
The App does not diagnose, assess, screen, treat, or evaluate any person. It is not a psychometric or clinical assessment, it has not been validated for employment selection or any other high-stakes decision, and it does not measure competence, aptitude, integrity, health, or fitness for any role. It does not generate personalized professional recommendations, and no human professional reviews your answers or your reading. The App produces general-interest interpretive content only.
3. No Professional Advice
All output of the App is informational and educational only. It is not psychological, medical, legal, financial, or employment advice, and it is not a substitute for consultation with a licensed or qualified professional. Nothing in the App constitutes psychological assessment or therapy, medical or mental-health guidance, legal counsel, financial or investment recommendation, or employment or human-resources advice.
Your use of the App does not create any professional, clinical, advisory, agency, or fiduciary relationship between you and Java Books, LLC, and no duty of care arises from your use of, or reliance on, the App. If you have questions about your mental health, your business, your finances, your legal position, or your employment practices, consult a qualified professional licensed in your jurisdiction.
4. User Responsibility
You are solely responsible for any decision or action you take based on the App's output, and for any consequence of that decision or action. This includes, without limitation, decisions about hiring, firing, promotion, team composition, compensation, business strategy, sales approach, client advice, partnership, investment, or personal wellbeing.
We strongly recommend that you independently verify any material on which you intend to rely, and that you consult an appropriate qualified professional before using any App output as an input to a significant decision. You agree not to use the App or its output as a basis for employment screening, performance evaluation, or any decision affecting another person's employment, credit, housing, insurance, or access to services, and you accept full responsibility if you do so in breach of this provision.
5. No Warranty
The App is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, Java Books, LLC disclaims all warranties, express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App's readings are accurate, complete, reliable, current, valid, or applicable to you or to anyone else; that the App will be uninterrupted, secure, or error-free; that defects will be corrected; or that any result obtained from the App will meet your expectations. Any material obtained through the App is used at your own discretion and risk.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Java Books, LLC, its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, opportunity, data, or anticipated savings, arising out of or relating to the App, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
Without limiting the foregoing, Java Books, LLC will not be liable for financial loss, business loss, employment or personnel outcomes, health or mental-health outcomes, reputational harm, or any decision made by you or by any third party using the App's output.
Our total aggregate liability for all claims arising out of or relating to the App will not exceed the greater of (a) the total amount you paid Java Books, LLC for the App in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
7. Indemnification
You agree to defend, indemnify, and hold harmless Java Books, LLC and its officers, directors, employees, contractors, and agents from and against any claim, demand, action, proceeding, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms or of any applicable law or regulation; (c) your use of App output in connection with any decision affecting another person, including any employment-related decision; or (d) your violation of the rights of any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claim.
8. Intellectual Property
Java Books, LLC owns, or licenses, all right, title, and interest in and to the material it created for the App: its name and branding, its design and user interface, its written content, its questionnaire statements, its type and role names and interpretations, its software and source code, and its exported report formats. All such material is protected by copyright, trademark, and other intellectual property laws.
The Enneagram itself — the nine-point model, its wings, and its growth and stress lines — is a long-standing body of work in general circulation. Java Books, LLC claims no ownership of that underlying framework, and nothing in these Terms should be read as asserting rights in it. Type names, descriptions, and business interpretations used in the App are Java Books, LLC's own wording and are not affiliated with, endorsed by, or derived from the branded materials of any Enneagram school, institute, or publisher.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and to retain your own reading for your personal or internal business use. Nothing in these Terms transfers any ownership interest to you. You may not copy, reproduce, republish, sell, license, reverse engineer, decompile, scrape, or create derivative works from the App or its methodology, or use it to build a competing product, except to the extent that such restriction is prohibited by applicable law.
9. Unsolicited Ideas and Feedback
If you submit feedback, suggestions, feature requests, bug reports, comments, concepts, or ideas to Java Books, LLC through any channel — a support form, a feedback widget, email, social media, or otherwise — you do so voluntarily and non-confidentially. No confidential or fiduciary relationship is created by your submission, and we are under no obligation to review, respond to, keep secret, or act on anything you submit.
You grant Java Books, LLC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable license to use, copy, modify, develop, commercialize, and otherwise exploit your submission for any purpose, without payment, attribution, credit, accounting, or any other obligation to you. Your submission does not create any ownership interest, joint-development claim, partnership, or right of any kind in the App, in its future direction, or in any product or feature that may resemble your submission, whether or not it was influenced by it. We may already be developing, or may independently develop, ideas similar to those you submit.
10. Dispute Resolution — Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Except as stated below, any dispute, claim, or controversy arising out of or relating to the App or to these Terms — including their formation, interpretation, breach, or termination — will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in the state named in Section 11, or by telephone, video, or documents-only submission where the rules permit. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
CLASS-ACTION WAIVER: You and Java Books, LLC each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
SMALL-CLAIMS CARVE-OUT: Either party may bring an individual action in a small-claims court of competent jurisdiction instead of arbitration, so long as the action remains in that court and on an individual basis. Either party may also seek injunctive or equitable relief in court to protect its intellectual property rights.
You may reject this arbitration agreement by sending written notice to customersarelikefish@gmail.com within thirty (30) days of first accepting these Terms, stating your name and your intent to opt out. Opting out does not affect any other part of these Terms.
11. Governing Law
These Terms and any dispute arising out of or relating to them or to the App are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles, and by the Federal Arbitration Act with respect to Section 10. Subject to Section 10, the state and federal courts located in California have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction and venue in those courts.
12. Changes to Terms
We may update these Terms from time to time. Each version carries a version identifier and an effective date shown at the top of this page. When we make a material change, we will publish the revised Terms here with a new version identifier and will present the acceptance screen again the next time you open the App, so that your acceptance of the new version is recorded.
Your continued use of the App after a revised version takes effect constitutes acceptance of that version. If you do not agree to a revised version, you must stop using the App.
